Actor Damon Wayans Jr. and the mother of his two daughters Aja Metoyer are back in court trying to renegotiate their custody agreement. The two share two teenage daughters together and up until now, Metoyer has had primary physical custody of the girls with both parents sharing joint legal custody.

Now, according to The Blast, Wayans wants primary, physical custody because he doesn’t believe Metoyer is prioritizing their daughters’ education and he questions how Metoyer is spending the child support money.

Wayans filed documents asking the judge to grant him primary physical custody of his 13 and 15-year-old daughters during the week because the girls are “suffering scholastically” because he claims that Metoyer has contributed to the girls being “habitually absent,” tardy to class as well as a host of other issues.

He says Metoyer constantly “puts her own needs before those” of their children, including taking one of their daughters on a cruise vacation when she was supposed to be summer school because she was falling behind in class. He also said Metoyer denies him visitation with his daughters.

These two daughters are 2/3 of Metoyer’s children. She also shares a 4-year-old son Xavier, who she shares with Dwyane Wade.

You may be wondering what Wade has to do with this, but Wayans mentioned him in his paperwork saying, “I do not know how [Metoyer] spends the child support money she receives from me or the father of her other child, a 4-year-old whose father is basketball star [Dwyane] Wade.”

Wayans said that his daughters are consistently left to care for their younger brother and it’s causing a problem for all the children.

The two will attend a custody mediation on October 31 to discuss Wayans’ request.

But there are two sides to every story. And Aja Metoyer said that Wayans’ new petition is an attempt to pay less child support.

Metoyer said that she has no plans of turning over primary custody because she believes all of this is a ploy to pay less money in child support.

Sources close to Metoyer told The Blast, she lawyered up because she finds it “curious” that Wayans was making a request for more custody right as he’s launching a new “lucrative” primetime network show “Happy Together.”

Metoyer has partnered with Mark Vincent Kaplan, the same attorney who secured a raise in child support for his client Kevin Federline against Britney Spears.

We’ll see how this plays out.
