Insurance Company Sues Trayvon Martin’s Mother

Trayvon Martin’s mother, Sybrina Fulton is being sued by Travelers Casualty and Surety Company of America–an insurance company trying to remove themselves from any responsibility of the unarmed teen’s death at the hands of George Zimmerman, according to an attorney for Martin’s family. Not only did the insurance company come for Fulton, they came for the The Retreat at Twin Lakes Homeowner’s Association–the gated community Martin was fatally shot in.

According to the Huffington Post, Travelers Casualty and Surety Company of America claims that it is not responsible to defend the homeowners association because of various clauses in the association’s policy, specifically a “wrongful act” exclusion. Benjamin Crump, the Martin family attorney told HuffPo, “It’s real simple: They are filing against the homeowners association and Sybrina because we are making a claim against them.”

    Hasn’t this woman have gone through enough? not even a year has passed since she buried her son. The heartlessness of business truly never ceases to amaze me.

    They didn’t sue her. It’s a method used by insurance companies. Essentially the insurance company is leaving the judgement as to what and how severe their responsibility in the matter is up to the judge. The judge will make the determination and from there the insurance company will (should) pay. They are not actually suing the Martins. Also, the “wrongful act” clause that the association signed their contract knowing was in there, can also protect the insurer from having to pay. Ultimately, the association may be deemed solely responsible for paying the Martins. Bottom line: the Martins are not being sued. Please people quite believing all of the hype on tv. Insurance companies are not the enemy. Do your research! Don’t allow others to feed you your thoughts! We end up looking silly and making unfounded and inaccurate arguments on important matters because we will not research for ourselves. if you do your research and still believe otherwise, then I can at least respect that.

    How does Fulton file a claim against the insurance company when the HOA didn’t even purchase the plan until after the shooting?

    I cannot wreck my car and then retroactively purchase car insurance after the fact.

      Exactly! As sad as this situation is, insurance companies/professional deal with tough situations (deaths, injury, negative financial impacts of a loss) every day. That doesn’t diminish the severity or importance of these each of these events collectively nor individually. However, if the policy was not in effect at the time of the loss, the company cannot be obligated to pay. Compensation should be sought from the company who’s policy was in effect at the time of the loss.
